Biographies
Selected by Best Lawyers as one of the top lawyers in Energy/Public Utility Law, Richard J. Johnson has concentrated on representation of regulated businesses since 1976. Mr. Johnson has individually or jointly represented private utility and telephone companies in 14 rate cases (2 electric, 2 gas and 10 telephone) and numerous earnings investigations. He has also been involved in a number of complex telephone hearings and numerous transactions. Mr. Johnson's experience has included primary legal responsibility in connection with: Defense against proposed consolidated tax adjustment in a rate to remove approximately $100 million from electric utility revenue requirement; Demonstration of no adverse impact by unregulated activities on cost of debt in revenue requirements for gas and electric utility rate cases; Demonstration of capital structures for revenue requirments, including divisional and subsidiary capital structures and preferred stock equivalence to common stock; Presentation of required ROEs for revenue requirements of gas, electric and telecommunications companies; Defense of employee compensation, including incentive compensation, in revenue requirements for gas, electric and telecommunications companies; Representation of groups of ILECs in several intrastate intercarrier compensation proceedings, including multi-week contested case proceedings; Preparation of comments for ILECs in FCC intercarrier compensation proceedings; Represenation of a group of ILECs in addressing unidentified traffic issues, including a traffic identification arrangement with Qwest; Defense of telecommunications companies in affiliated interest investigations; Defense of current earnings levels in connections with earnings investigations; Presentation of certification application for state-wide telecommunications network, including multi-week contested case proceeding; Representation of ILECs in connection with ETC applications of CMRS providers; Strategic planning and documentation of several telecommunications joint ventures; Negotiation, documentation and regulatory representation in connection with numerous mergers, sales and acquisition.
